Terms of Service

These Terms of Service ("Terms") govern your use of the Lydia mobile application and the lydia.live website (collectively, the "Service"), operated by KD Creative LLC ("we," "us," or "our"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Lydia. By creating an account, you represent that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to keep it up to date. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

When using Lydia, you agree not to:

• Post false, misleading, or deceptive content (e.g., fake events or impersonated profiles).
• Harass, threaten, or abuse other users.
• Use the Service for any unlawful purpose.
• Attempt to access accounts, systems, or data that do not belong to you.
• Scrape, crawl, or collect data from the Service without our written permission.
• Upload content that infringes on the intellectual property rights of others.

4. User Content

You retain ownership of content you post on Lydia (bios, photos, event listings, etc.). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote that content within the Service. You may delete your content at any time, which will remove it from the Service (though cached or shared copies may persist briefly).

5. Venue and Event Listings

Venue operators and event organizers are solely responsible for the accuracy of their listings, including dates, times, locations, pricing, and age restrictions. Lydia does not verify event details and is not liable for inaccuracies in user-submitted listings.

6. Intellectual Property

The Lydia name, logo, and app design are the property of KD Creative LLC. You may not use our trademarks without written permission. The Service and its original content (excluding user content) are protected by copyright and other intellectual property laws.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We are not responsible for the actions, content, or conduct of any users.

8. Limitation of Liability

To the fullest extent permitted by law, KD Creative LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Franklin County, Ohio.
